On March 31, 2004 an amendment to the Criminal Code of Canada came into effect under Bill C-45 (Health & Safety Negligence) that states any employer can be held criminally liable for not investigating the status of indoor air quality within the workplace. This can result in criminal charges against the corporations directors, the organization, or the sole proprietor of the business. In short, by not investigating air quality complaints by employees, the employer is exposed to liability and would now be considered negligent in their duty to provide a safe work environment.
